EVENT TERMS AND CONDITIONS

​

1. ABOUT THESE TERMS

​

1.1 Tribal Clash Limited is a company registered in England and Wales with company number 15094569 ("Tribal Clash", "we", "us" or "our").

1.2 These terms and conditions ("T&Cs") govern:

(a) the purchase and use of Tickets for a Tribal Clash Event;

(b) registration for an Event;

(c) participation in or attendance at an Event;

(d) athlete and team substitutions;

(e) cancellations, withdrawals and changes to an Event; and

(f) Your conduct while attending or participating in an Event.

1.3 These T&Cs apply to Tickets purchased directly from Tribal Clash and, where applicable, Tickets sold through an authorised ticketing provider or other authorised sales channel.

1.4 Please read these T&Cs carefully before purchasing a Ticket or registering for an Event.

1.5 By purchasing a Ticket, registering for an Event, participating in an Event or attending an Event, You agree to be bound by these T&Cs and any applicable Event Rules.

1.6 If You purchase a Ticket on behalf of another person or register another person as part of a team, You must ensure that person is made aware of these T&Cs and any Event Rules that apply to them.

1.7 Nothing in these T&Cs affects any statutory rights which You are entitled to as a consumer and which cannot lawfully be excluded or restricted.

2. DEFINITIONS

​

In these T&Cs:

"Athlete" means any individual registered to participate competitively or non-competitively in an Event.

"Event" means a competitive or non-competitive functional fitness event owned, organised or operated by Tribal Clash for which You have registered, purchased a Ticket or otherwise been authorised to participate in or attend.

"Event Rules" means the rules, regulations, standards, instructions and competition requirements issued by Tribal Clash in relation to an Event, including rules concerning eligibility, workouts, movement standards, judging, scoring, penalties, substitutions, conduct and safety.

"Force Majeure Event" means an event or circumstance beyond Tribal Clash's reasonable control which could not reasonably have been prevented or avoided, including severe or dangerous weather, flood, fire, epidemic or pandemic, acts or restrictions of government or public authorities, war, terrorism, civil disturbance, industrial action, failure of essential utilities or infrastructure, Venue unavailability caused by circumstances beyond our reasonable control, or any other comparable event beyond our reasonable control.

"Intellectual Property Rights" or "IPR" means all intellectual property rights belonging to or licensed to Tribal Clash, including trade marks, logos, branding, copyright, designs, photographs, video content, Event materials, workout formats and other proprietary content.

"Registration Day" means the day or period designated by Tribal Clash for Athlete or team registration immediately before or at the beginning of the Event.

"Team" means a team registered to participate in an Event.

"Ticket" means a valid ticket, entry, registration, accreditation or wristband which permits an individual or Team to participate in or attend an Event.

"Venue" means the site or sites at which the Event takes place.

"Website" means the Tribal Clash website and any authorised website or platform through which Tribal Clash sells Tickets or provides Event information.

"You" and "Your" means the purchaser or holder of a Ticket, Athlete, Team member, spectator or other person attending or participating in the Event, as applicable.

3. TICKETS AND ENTRY

​

3.1 Only persons holding or allocated a valid Ticket or other valid accreditation will be permitted to participate in or attend the Event where a Ticket or accreditation is required.

3.2 You must provide accurate information when purchasing a Ticket or registering for an Event.

3.3 You represent that You have legal authority to complete any registration or Ticket purchase made by You.

3.4 Where You purchase Tickets or register on behalf of another person, You are responsible for providing accurate information concerning that person and for ensuring that they complete any registration, acknowledgement or other documentation required directly from them.

3.5 Where wristbands or other physical accreditation are issued, they must be retained and, where required by Tribal Clash, worn throughout the Event.

3.6 Tribal Clash may refuse admission where a Ticket:

(a) is invalid;

(b) has been obtained fraudulently;

(c) has been transferred or resold contrary to these T&Cs;

(d) has been cancelled; or

(e) cannot reasonably be verified.

3.7 Purchasing or possessing a Ticket does not grant You any right to use Tribal Clash's name, logos, branding, photographs, Event content or other Intellectual Property Rights.

4. TICKET PRICES AND RESALE

​

4.1 Ticket prices may change before purchase at Tribal Clash's discretion.

4.2 Any subsequent change in Ticket price will not alter the price already agreed and paid for a completed purchase.

4.3 Any compulsory fees or charges applicable to a Ticket will be communicated as part of the purchasing process in accordance with applicable law.

4.4 Unless expressly permitted by Tribal Clash, Tickets and Team entries must not be commercially resold, auctioned or transferred to another person.

4.5 Tribal Clash may cancel any Ticket which it reasonably believes has been resold or transferred without authorisation.

4.6 Clause 4.4 does not prevent an authorised Athlete substitution within a Team made in accordance with clause 7.

5. UNDER-18s

​

5.1 Athletes must satisfy any minimum age requirements specified for the relevant Event or competition category.

5.2 Where an Athlete is under the age of 18, participation is subject to the consent of their parent or legal guardian and completion of any declaration, consent form or other documentation required by Tribal Clash.

5.3 Tribal Clash may refuse participation by an Athlete under the age of 18 where the required consent or documentation has not been provided.

5.4 Additional age restrictions may apply to particular workouts, activities or competition categories for safety, insurance or regulatory reasons.

6. WITHDRAWAL BY AN ATHLETE OR TEAM

​

6.1 If You or Your Team wishes to withdraw from an Event, You should notify Tribal Clash as soon as reasonably practicable.

6.2 Except where these T&Cs expressly state otherwise or where required by law, withdrawal by You or Your Team does not entitle You to a refund, credit, transfer or deferral to another Tribal Clash event.

6.3 This includes withdrawal or inability to participate because of:

(a) injury or illness;

(b) pregnancy;

(c) travel disruption;

(d) work or personal commitments;

(e) changes in personal circumstances;

(f) failure to obtain necessary travel documentation;

(g) failure to assemble a complete Team; or

(h) any other circumstance affecting You or Your Team rather than the Event itself.

6.4 Where a payment plan applies and required payments are not made in accordance with that plan, Tribal Clash may cancel the applicable Team entry.

6.5 Camping, parking, spectator and other ancillary Tickets or passes are non-refundable except where expressly stated in these T&Cs or required by law.

7. ATHLETE AND TEAM SUBSTITUTIONS

​

7.1 A Team may substitute or replace a registered Athlete at any time up to and including Registration Day for the relevant Event.

7.2 All substitute Athletes must:

(a) satisfy the applicable eligibility requirements;

(b) provide any information reasonably required by Tribal Clash;

(c) complete any required registration, acknowledgements or declarations;

(d) agree to these T&Cs and the Event Rules; and

(e) satisfy any applicable age or competition-category requirements.

7.3 Once the Event has commenced, an Athlete may only be substituted with the approval of Tribal Clash.

7.4 Where a Team substitutes an Athlete after the Event has commenced, the Team may, subject to Tribal Clash's approval and any safety considerations, continue to participate in the remaining workouts.

7.5 A Team making an Athlete substitution after the Event has commenced will forfeit its competitive leaderboard position.

7.6 Such a Team will no longer be eligible for an official competitive placing, podium position, prize, qualification place or award at that Event, although its subsequent workout results may be recorded or displayed at Tribal Clash's discretion.

7.7 Tribal Clash may refuse a substitution where it reasonably considers that the substitution:

(a) creates a safety concern;

(b) breaches eligibility requirements;

(c) could provide an unfair competitive advantage;

(d) breaches the Event Rules; or

(e) would materially interfere with the proper operation of the Event.

8. EVENT PROGRAMME AND SCHEDULE

​

8.1 Tribal Clash may design and determine the Event programme, including:

(a) workouts;

(b) workout order;

(c) heats;

(d) start times;

(e) locations;

(f) equipment;

(g) movement standards;

(h) judging arrangements; and

(i) competition format.

8.2 Published Event schedules and start and finish times are estimates and may change.

8.3 Tribal Clash may make reasonable changes to Event timings, workouts, workout locations, heats, equipment, competition format or other operational aspects where necessary or appropriate.

8.4 Changes may be made for reasons including:

(a) safety;

(b) weather;

(c) Venue restrictions;

(d) Athlete numbers;

(e) equipment availability;

(f) judging requirements;

(g) operational requirements;

(h) fairness of competition; or

(i) circumstances beyond Tribal Clash's reasonable control.

8.5 You are responsible for monitoring official Event communications and ensuring that You are available at the times communicated by Tribal Clash.

9. EVENT RULES

​

9.1 Tribal Clash may establish, interpret, amend and enforce Event Rules.

9.2 Event Rules may include rules relating to:

(a) Athlete and Team eligibility;

(b) competition categories;

(c) workouts;

(d) movement and performance standards;

(e) equipment;

(f) scoring;

(g) penalties;

(h) judging;

(i) heats and qualification;

(j) leaderboard positions;

(k) Athlete substitutions;

(l) conduct;

(m) safety; and

(n) any other matter reasonably required to administer the Event.

9.3 Tribal Clash may amend the Event Rules before or during an Event where it reasonably considers an amendment necessary or appropriate for safety, fairness, operational requirements, weather conditions, Venue or equipment constraints, judging requirements or the effective administration of the competition.

9.4 Where reasonably practicable, material changes affecting Athletes will be communicated to affected Athletes or Teams.

9.5 You must comply with the Event Rules and reasonable instructions given by Tribal Clash, judges, Event officials, safety personnel, medical personnel and other authorised Event staff.

9.6 Decisions concerning scoring, judging, penalties and interpretation or application of the Event Rules will be made by Tribal Clash or its appointed officials.

9.7 Subject to any appeals procedure expressly published for the Event, competition decisions made by Tribal Clash or its appointed officials will be final.

9.8 Tribal Clash's ability to amend Event Rules does not give Tribal Clash an unrestricted right to retrospectively change these T&Cs or remove statutory rights available to You.

10. CANCELLATION BY TRIBAL CLASH

​

10.1 If Tribal Clash cancels the Event and the Event does not take place, affected Ticket purchasers will be offered:

(a) a refund of the applicable Ticket price paid; or

(b) where offered by Tribal Clash, the option to defer or transfer the value of the Ticket to a future Tribal Clash event.

10.2 Tribal Clash will communicate the applicable refund or deferral process following cancellation.

10.3 You must make any refund or deferral request within the reasonable period specified in that communication.

10.4 Refunds will normally be made to the original payment method where reasonably possible.

10.5 Except where required by law, Tribal Clash will not be responsible for travel, accommodation, equipment, food, loss of earnings or other costs or expenses incurred by You in connection with an Event which is subsequently cancelled.

11. POSTPONEMENT AND CHANGES TO THE EVENT

​

11.1 Where circumstances reasonably require it, Tribal Clash may postpone, reschedule, relocate or alter an Event rather than cancel it.

11.2 A change to the Event does not automatically constitute cancellation.

11.3 Where an Event is postponed, rescheduled or materially changed, Tribal Clash will communicate the arrangements applying to affected Tickets.

11.4 Any rights or options available to Ticket holders following postponement, rescheduling or material changes will be communicated by Tribal Clash and will be subject to Your statutory rights.

11.5 Nothing in this clause limits any consumer right which cannot lawfully be excluded or restricted.

12. FORCE MAJEURE

​

12.1 Tribal Clash will not be liable for a failure or delay in performing its obligations to the extent that the failure or delay results from a Force Majeure Event.

12.2 Where a Force Majeure Event affects the Event, Tribal Clash may take reasonable steps including:

(a) changing the Event timetable;

(b) changing workouts;

(c) modifying the competition format;

(d) changing locations within the Venue;

(e) postponing the Event;

(f) suspending part of the Event; or

(g) cancelling the Event where reasonably necessary.

12.3 Where a Force Majeure Event results in cancellation of the Event before it takes place, clause 10 will apply.

12.4 Tribal Clash will not be liable for consequential or external costs incurred by You as a result of a Force Majeure Event, including travel or accommodation costs, except where liability cannot lawfully be excluded.

13. PARTICIPATION AND FITNESS TO COMPETE

​

13.1 You acknowledge that functional fitness competitions are physically demanding and involve inherent risks.

13.2 Depending on the Event and workouts, those risks may include risks associated with:

(a) running;

(b) lifting, carrying, pushing or pulling weights or objects;

(c) high-intensity exercise;

(d) gymnastics or bodyweight movements;

(e) obstacles;

(f) uneven, wet, sandy or unstable surfaces;

(g) outdoor environments;

(h) adverse or changing weather;

(i) water-based activities where applicable;

(j) contact or collision with equipment or other participants;

(k) fatigue;

(l) falls; and

(m) other strenuous physical activity.

13.3 By participating, You confirm that You understand the nature of the Event and the inherent risks associated with participation.

13.4 You are responsible for determining whether You are physically capable of participating.

13.5 If You have concerns about Your ability to participate safely, You should obtain appropriate professional medical advice before participating.

13.6 You must not participate where You know or reasonably ought to know that doing so would present an unacceptable risk to Your health or safety or the health or safety of another person.

13.7 You must immediately stop participating and notify an Event official if instructed to do so by medical, safety or Event personnel.

13.8 Tribal Clash may prevent or stop an Athlete from participating where it reasonably considers this necessary for the safety of that Athlete or another person.

14. CONDUCT, DISQUALIFICATION AND REMOVAL

​

14.1 Tribal Clash may refuse entry, disqualify, suspend or remove an Athlete, Team, spectator or other attendee where it reasonably considers this necessary because of:

(a) unsafe behaviour;

(b) abusive, threatening, discriminatory or violent behaviour;

(c) harassment;

(d) intoxication or misuse of drugs;

(e) cheating or deliberate manipulation of competition results;

(f) interference with judges, officials or other Athletes;

(g) serious or repeated breach of Event Rules;

(h) failure to comply with reasonable instructions;

(i) damage to the Venue or Event property;

(j) conduct creating a risk to another person; or

(k) other serious misconduct affecting the safe or proper operation of the Event.

14.2 Depending on the circumstances, Tribal Clash may impose a warning, workout penalty, score adjustment, disqualification, removal from the leaderboard or removal from the Event.

14.3 Tribal Clash may immediately remove a person without prior warning where reasonably necessary for safety or because of serious misconduct.

14.4 Where an Athlete or Team is disqualified or removed because of their own conduct or breach of these T&Cs or Event Rules, no refund will be payable except where required by law.

15. PROHIBITED ITEMS AND VENUE RULES

​

15.1 You must comply with all reasonable Venue rules and security requirements.

15.2 You must not bring into the Venue any item which:

(a) is unlawful;

(b) may reasonably be regarded as dangerous;

(c) could be used as a weapon;

(d) is prohibited by the Venue;

(e) creates an unreasonable safety risk; or

(f) Tribal Clash has expressly identified as prohibited.

15.3 Tribal Clash or Venue security may require reasonable bag or security checks as a condition of entry where permitted by law.

15.4 There will be no admission to the Venue before designated opening times unless authorised by Tribal Clash.

16. FOOD, DRINK AND ALLERGIES

​

16.1 You may bring a reasonable quantity of food and non-alcoholic drink for Your personal use, subject to Venue restrictions communicated by Tribal Clash.

16.2 Where food or drink is supplied by independent traders, caterers or vendors, those businesses may be responsible for the products they supply.

16.3 If You have an allergy or dietary requirement, You are responsible for making appropriate enquiries before consuming food or drink.

16.4 Nothing in these T&Cs excludes liability arising from negligence or any other liability which cannot lawfully be excluded.

17. PERSONAL PROPERTY

​

17.1 You are responsible for Your personal belongings while attending the Event.

17.2 Tribal Clash recommends that valuable items are not left unattended.

17.3 To the extent permitted by law, Tribal Clash will not be responsible for loss, theft or damage to personal property unless caused by Tribal Clash's negligence or another matter for which liability cannot lawfully be excluded.

17.4 Any lost property recovered following the Event may be retained for a reasonable period before being disposed of or donated.

18. PHOTOGRAPHY, FILMING AND BROADCASTING

​

18.1 Tribal Clash Events may be photographed, filmed, livestreamed, recorded or otherwise documented by Tribal Clash and its authorised photographers, production teams and media partners.

18.2 By attending an Event, You acknowledge that You may appear incidentally in photographs, video footage, livestreams, broadcasts or other recordings of the Event.

18.3 Tribal Clash may use Event imagery and recordings for legitimate purposes connected with documenting, reporting on and promoting Tribal Clash and its Events, subject to applicable data protection and privacy law.

18.4 Further information about how Tribal Clash processes personal information in connection with photography and filming will be provided in Tribal Clash's Privacy Policy.

18.5 Where Tribal Clash wishes to use an identifiable individual prominently for a purpose requiring separate consent under applicable law, Tribal Clash will obtain such consent where required.

18.6 Unauthorised commercial photography, filming, livestreaming or exploitation of Event footage may be prohibited.

19. PERSONAL DATA AND MEDICAL INFORMATION

​

19.1 Tribal Clash will process personal information in accordance with applicable data protection law and its Privacy Policy.

19.2 Personal information may be processed where reasonably necessary to:

(a) administer Ticket purchases;

(b) register Athletes and Teams;

(c) operate the Event;

(d) communicate Event information;

(e) administer scoring and results;

(f) manage safety and security;

(g) respond to incidents;

(h) provide or facilitate medical assistance;

(i) comply with legal obligations; and

(j) carry out other purposes described in the Privacy Policy.

19.3 Where information concerning Your health is required for Event safety or medical purposes, such information will be handled in accordance with applicable data protection law.

19.4 You must not provide another person's health or other sensitive personal information unless You are authorised or otherwise legally permitted to provide it.

19.5 Where reasonably necessary, relevant information may be provided to medical personnel, emergency services, Event safety personnel or other appropriate persons in connection with an emergency or medical incident.

19.6 Any sharing of participant information with a governing body, affiliated organisation or other third party will be undertaken in accordance with applicable law and the Tribal Clash Privacy Policy.

20. COMMERCIAL ACTIVITY AT THE EVENT

​

20.1 You must not use the Event for unauthorised commercial, promotional or marketing activity.

20.2 Without Tribal Clash's prior approval, You must not:

(a) sell products or services;

(b) distribute commercial promotional materials;

(c) conduct unauthorised sampling;

(d) erect commercial signage;

(e) undertake ambush marketing; or

(f) otherwise imply a commercial association with Tribal Clash or the Event.

20.3 Nothing in this clause prevents reasonable personal social-media activity by Athletes or spectators, subject to the Event Rules and the rights of others.

21. INTELLECTUAL PROPERTY

​

21.1 All Intellectual Property Rights belonging to Tribal Clash remain the property of Tribal Clash or its applicable licensors.

21.2 Purchasing a Ticket or participating in an Event does not grant You ownership of, or a licence to commercially exploit, Tribal Clash Intellectual Property Rights.

21.3 You must not use Tribal Clash branding in a way that falsely suggests sponsorship, endorsement, partnership or other commercial association without prior permission.

22. LIABILITY

​

22.1 Nothing in these T&Cs excludes or limits liability for:

(a) death or personal injury caused by negligence;

(b) fraud or fraudulent misrepresentation; or

(c) any other liability which cannot lawfully be excluded or limited.

22.2 Participation in a functional fitness Event involves inherent risks which cannot be completely eliminated even where reasonable care is taken.

22.3 Tribal Clash is not responsible for injury, loss or damage resulting solely from risks inherent in the activity which have not been caused by Tribal Clash's negligence or breach of legal duty.

22.4 Tribal Clash will not be responsible for loss or damage caused by Your:

(a) failure to comply with these T&Cs;

(b) failure to comply with Event Rules;

(c) disregard of reasonable safety instructions;

(d) misuse of equipment; or

(e) deliberate, reckless or negligent conduct,

to the extent that such conduct caused or contributed to the loss or damage.

22.5 Where You are acting as a consumer, Tribal Clash does not exclude or restrict any liability or remedy which cannot lawfully be excluded or restricted.

22.6 Subject to clause 22.1 and applicable law, Tribal Clash will not be responsible for losses which were not reasonably foreseeable when the contract was entered into.

22.7 Tribal Clash will not be responsible for business losses suffered by a consumer, including loss of business, revenue, profit or business opportunity, arising from attendance at or participation in an Event.

23. COMPLAINTS AND EVENT ISSUES

​

23.1 If You experience a problem during the Event, You should raise it with Tribal Clash or an Event official as soon as reasonably practicable so that Tribal Clash has an opportunity to address the issue.

23.2 Complaints following the Event should be submitted using the contact details published by Tribal Clash.

23.3 Competition disputes concerning judging, scores or penalties must be raised in accordance with any Event-specific appeals procedure and applicable time limits.

24. ACCESSIBILITY

24.1 Tribal Clash aims to accommodate the reasonable needs of spectators and participants with disabilities or access requirements.

24.2 If You have an access requirement, You should contact Tribal Clash sufficiently in advance of the Event so that available arrangements can be discussed.

24.3 The nature of particular competition workouts may mean that not every activity can be adapted without materially changing the competition, but Tribal Clash will consider reasonable arrangements where appropriate.

25. CHANGES TO THESE T&Cs

​

25.1 Tribal Clash may update these T&Cs from time to time for future Ticket purchases and future Events.

25.2 The version applicable to Your Ticket will normally be the version in force when Your Ticket was purchased.

25.3 Tribal Clash may make reasonable changes affecting an existing Event where necessary to:

(a) comply with law or regulatory requirements;

(b) address safety or security issues;

(c) correct an obvious error;

(d) reflect circumstances beyond Tribal Clash's reasonable control; or

(e) make a change which does not materially disadvantage You.

25.4 Nothing in this clause permits Tribal Clash to remove or restrict a statutory consumer right.

25.5 Competition and operational rules may separately be amended in accordance with clause 9.

26. GENERAL

​

26.1 If any provision or part of a provision of these T&Cs is found to be invalid, unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary to make it valid and enforceable. If that is not possible, the affected provision will be treated as deleted.

26.2 Any modification or deletion under clause 26.1 will not affect the validity of the remaining provisions.

26.3 A failure or delay by Tribal Clash in exercising a right under these T&Cs does not waive that right.

26.4 These T&Cs, together with any documents expressly incorporated into them, form the agreement governing Your Ticket and participation in or attendance at the Event.

26.5 Nothing in these T&Cs creates a partnership, employment relationship or agency relationship between Tribal Clash and an Athlete, Team member or spectator.

26.6 Headings are included for convenience and do not affect interpretation.

27. GOVERNING LAW AND JURISDICTION

​

27.1 These T&Cs and any dispute or claim arising from them are governed by the laws of England and Wales.

27.2 If You are a consumer resident elsewhere, You will continue to benefit from any mandatory protections available to You under applicable consumer law.

27.3 If You are a consumer, You may bring proceedings in any court which has jurisdiction under applicable law.

27.4 If You are acting in the course of business, the courts of England and Wales will have exclusive jurisdiction over any dispute arising from these T&Cs.
